Terms of Use

1. Who we are

SMCM (smcm.io, the "Site") is an independent educational and comparison website for traders. "SMCM" is a brand name, not a company: the Site is operated jointly by Yakir Malka and Gal Malka, two individuals based in Israel. Contact for legal notices: legal@smcm.io.

2. Acceptance and eligibility

By using the Site you agree to these Terms of Use. If you do not agree, please do not use the Site. The Site is intended only for users aged 18 or older (or the age of majority where you live, if higher). By continuing, you confirm that you are at least 18 years old.

3. What SMCM is — and is not

SMCM publishes educational content, research, factual comparisons and editorial reviews about trading-related services: proprietary/funded trading programs, brokers, trading platforms, crypto wallets and related products. Some links to those providers are affiliate links (see our Affiliate Disclosure).

SMCM is not an investment adviser, portfolio manager, broker, trading venue, signals or copy-trading service, custodian or payment institution. SMCM does not execute trades, accept deposits, hold client funds, manage accounts, or provide personalised financial, investment, legal or tax advice — and nothing on the Site should be read as doing so. 4. Comparisons, filters and the quiz

Comparison tables, filters and the Trader Fit Quiz are educational orientation tools. They organise factual criteria you select; they do not assess your financial circumstances, objectives, experience or risk tolerance, and their output is not a personal recommendation or suitability assessment. Any decision to register with or pay a provider is yours alone, based on the provider's current official terms.

5. Third-party providers

The providers we review are independent third parties. SMCM is not a party to any contract between you and a provider — including where you reached the provider through a link on the Site. SMCM does not control, and is not responsible for, a provider's acceptance decisions, account opening, evaluation results, rule enforcement, account closures, payouts, pricing, platform uptime, solvency or continued operation. Always review the provider's own current terms, pricing and eligibility before registering or paying.

6. Information accuracy

We aim to keep information accurate and periodically re-check important facts (see our Editorial & Ranking Methodology). However, provider rules, prices, promotions, payout terms, platform support and country eligibility can change at any time and without notice, and we cannot guarantee that every third-party fact is current at every moment. Availability, eligibility and provider terms may depend on your country — verify your eligibility and the provider's current terms directly with the provider. 7. Intellectual property and permitted use

SMCM's original content — articles, guides, reviews, comparison data compilations, graphics and design — belongs to the Site's operator. You may read, bookmark, link to and make limited personal, non-commercial copies of public pages. Without written permission you may not: reproduce or republish substantial content commercially; copy in bulk, scrape or systematically extract data; build a competing comparison database from SMCM content; resell SMCM content; harvest content by automated means or ingest substantial SMCM datasets to train commercial AI or machine-learning systems; remove copyright notices; misattribute content; or use SMCM branding without authorisation.

Third-party product names, logos and trademarks appearing on the Site belong to their respective owners and are used for identification and review purposes only. Their use does not imply affiliation, sponsorship or endorsement. Rights holders with concerns can contact us and we will address them promptly.

8. Acceptable use

You agree not to interfere with the Site's operation, attempt unauthorised access, introduce malicious code, or use the Site in any unlawful way.

9. Disclaimer of warranties

The Site and its content are provided on an "as is" and "as available" basis, without warranties of any kind — including as to uninterrupted availability, completeness, accuracy at any given moment, future provider conduct, or any financial outcome.

10. Limitation of liability

To the fullest extent permitted by applicable law, SMCM and those who operate it are not liable for losses arising from your use of, or reliance on, the Site — including trading or investment losses; lost evaluation or challenge fees; denied payouts; provider account closures or rule enforcement; provider insolvency, fraud or discontinued operation; third-party outages or security incidents; inaccurate or outdated third-party information; or any indirect or consequential loss, loss of profit, revenue, opportunity or data.

To the extent liability cannot be excluded, and to the fullest extent permitted by applicable law, total aggregate liability is limited to the greater of (a) the amounts (if any) you paid directly to SMCM for use of the Site in the 12 months before the event giving rise to the claim, or (b) USD 100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, or overrides mandatory consumer, privacy or other statutory rights you hold under applicable law in your place of residence.

11. Indemnification

If you cause harm through unlawful use of the Site, material breach of these Terms, infringement of third-party intellectual-property rights, malicious interference with the Site, unauthorised automated extraction, or fraud or intentional misconduct, you agree to indemnify SMCM and those who operate it against third-party claims, losses and reasonable costs arising from that conduct. This clause is not intended to burden ordinary, good-faith browsing of the Site.

12. Changes

We may update the Site and these Terms. For material changes we will use reasonable means of notice (such as a notice on the Site). Continued use after a change takes effect means you accept the updated Terms. Each version shows its effective date.

13. Governing law and disputes

These Terms are governed by the laws of the State of Israel, and the competent courts in Tel Aviv-Jaffa, Israel have jurisdiction over disputes arising from them — without depriving you of mandatory consumer, privacy or other statutory protections (including any right to bring proceedings) that applicable law in your place of residence grants you and that cannot lawfully be waived.

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. A failure to enforce a provision is not a waiver of it. These Terms, together with the policies they reference, are the entire agreement between you and SMCM regarding the Site.
